1. Introduction
Welcome to bookaLEAP, a service provided by bookaLEAP B.V.,
registered in the Netherlands at Jan Pieter Heijestraat 107H, 1053 GN,
Amsterdam (KvK 89959973) (“bookaLEAP”, “we”, “us”, or “our”). These
Terms and Conditions (“Terms”) govern your use of our platform, apps,
and services.
By creating an account, booking a session or event, or using any part
of our platform, you agree to these Terms.
2. Our Services
bookaLEAP offers:
- A marketplace platform where users (“Clients”) can
book services from independent sports and wellness professionals
(“Partners”) and from studios or gyms (“Businesses”) — including 1:1
appointments, class packs / punch cards, and combined offers.
- Events, which may be organized directly by
bookaLEAP or by Partners and Businesses using the platform
(“Organizers”). Each event listing states who the organizer is; where
the organizer is not bookaLEAP, the contract for the event is between
you and that Organizer.
3. Accounts and Eligibility
- Accounts are created with a phone number verified by SMS code. You
may additionally sign in with Google or Apple; those identities are
linked to your phone-verified account.
- You must be at least 16 years old to create a bookaLEAP account. If
you are under 18, a parent or legal guardian must consent to your use of
the platform and to your participation in any session or event, and that
parent or guardian agrees to be bound by these Terms — including Section
6 — on your behalf.
- You agree to provide accurate information and keep it up to
date.
4. Booking and Payments
- All payments are processed by Stripe. Available
payment methods include card (including Apple Pay and Google Pay),
iDEAL, SEPA Direct Debit, and Multibanco. Your card and bank details are
collected by Stripe directly and never stored by bookaLEAP.
- Unless a listing states otherwise, bookaLEAP acts as
merchant of record for platform purchases and issues
the invoice for your purchase; for marketplace services the contract for
the service itself remains between you and the Partner or Business.
Where bookaLEAP instead acts as disclosed agent for a listing, this is
stated on the listing or invoice.
- When you start a booking for a time slot, the slot is reserved for a
short hold period (currently 30 minutes) while you complete payment. If
payment is not completed in time, the hold lapses and the slot may
become available to others.
- If a slot or ticket becomes unavailable before your payment settles
(for example a double-booking collision or a sold-out price tier), your
booking is cancelled and your payment is automatically refunded in
full.
- All prices are shown in euros and include VAT where applicable.
Promo codes and LEAP coins — bookaLEAP’s in-app credit, earned through
promotions or issued as one of the two refund methods (Section 5.6) —
may reduce the price. LEAP coins have no cash value and cannot be
redeemed for cash or transferred.
- Class packs / punch cards and combined offers are valid for 12
months from purchase unless the listing states a different validity
period. Unused credits expire at the end of the validity period.
- By completing a booking, you confirm that you have read and accept
the Cancellation & Refund Policy (Section 5) and the Liability
Disclaimer & Assumption of Risk (Section 6) applicable to that
booking.
5. Cancellations and Refunds
5.1
Appointments and Sessions (1:1 Personal Training, Nutrition, Wellness,
Classes)
- Each session has its own cancellation window, set by the Partner or
Business and shown to you when you book. You may cancel a booked session
up until that window closes; the app shows you the exact cutoff and,
before you confirm cancellation, the amount you will get back.
- Cancelling before the cutoff: full refund of what
you paid, less any LEAP coins bonus that purchase earned you. Whether
that refund reaches you as money or as LEAP coins depends on how soon
after payment you cancel — see Section 5.6.
- Cancelling after the cutoff, or not attending: no
refund.
- If a Partner or Business cancels your session, you are entitled to a
full refund of what you paid for that session, regardless of timing,
returned to your original payment method.
- Sessions booked with a punch-card or combo-pack credit follow the
same cutoff, applied to the credit: cancelling before it returns the
session credit to your pack; cancelling after it forfeits the
credit.
- Cancelling a session releases the slot immediately.
5.2 Events
Running an event requires committing in advance to costs such as
venue rental, coaching staff, equipment, and marketing. You may cancel
your registration up until the cancellation deadline shown for that
event (a fixed number of hours before it starts); the app shows you the
exact deadline and, before you confirm cancellation, the amount you will
get back.
- Cancelling before the deadline: full refund of what
you paid, less any LEAP coins bonus that purchase earned you. Whether
that refund reaches you as money or as LEAP coins depends on how soon
after payment you cancel — see Section 5.6. A free registration may
always be cancelled.
- Cancelling after the deadline gives no refund,
including for change of mind, late arrival or no-show, and inability to
attend for personal reasons such as illness, travel, or scheduling
conflicts — unless a refund is required by mandatory law, or Section 5.3
applies.
By purchasing a ticket, you acknowledge and accept this cancellation
policy as a condition of your booking.
5.3 Exceptions —
When a Refund or Credit Is Owed
Regardless of Section 5.2, you will be offered a full refund or, at
your choice, a credit toward a future event, if:
- The organizer cancels the event;
- The organizer reschedules the event to a date or time you cannot
attend;
- A refund is otherwise required by mandatory Dutch or EU consumer
protection law.
5.4
Cancellation by bookaLEAP of an Individual Booking
Separately from an Organizer cancelling a whole event (Section 5.3),
bookaLEAP may cancel your individual booking or registration and remove
you from the session or event. Where we do so, we will tell you and give
the reason.
Where the cancellation is attributable to you, no refund and
no LEAP coins are due, and the amount you paid is not returned.
This applies where we cancel your booking because:
- you have breached these Terms or the Code of Conduct, or your
participation would put your own or another participant’s safety at
risk;
- the booking is fraudulent, was paid by a disputed or reversed
payment, or abuses promotions, promo codes, or LEAP coins;
- you did not attend and did not cancel in time under Section 5.1 or
5.2; or
- the booking is a duplicate of another booking you hold for the same
session or event.
In every other case — including where we cancel for our own
operational reasons — you are entitled to a refund of what you paid for
that booking, returned to your original payment method, or at
your choice a credit toward a future booking. Because the cancellation
is ours and not yours, no time limit applies to this: the cash-refund
window in Section 5.6 governs your own cancellations only.
Nothing in this Section limits your rights under mandatory Dutch or
EU consumer protection law. Where such law entitles you to a refund, you
will receive it regardless of the reason for the cancellation. If you
believe your booking was cancelled without a valid reason, contact us at
info@bookaleap.com; disputes are handled under Section 12.
Where a booking cancelled under this Section was paid partly with
LEAP coins, the coins you spent as a discount are returned to your
balance even where the cash you paid is not refunded — those coins were
credit you already held, not payment for the cancelled booking.
5.5 Statutory Right of
Withdrawal
Under Article 6:230p of the Dutch Civil Code, implementing Article
16(l) of EU Directive 2011/83/EU, the standard 14-day right of
withdrawal for online purchases does not apply to bookings for leisure
services to be performed on a specific date or within a specific period.
As all events and personalised sessions offered through bookaLEAP are
scheduled for a specific date and time, that statutory right does not
apply once a booking is confirmed, and Sections 5.1–5.4 govern
cancellations instead.
The cash-refund window described in Section 5.6 is something we offer
voluntarily, as a contractual right under these Terms. It is not the
statutory right of withdrawal, it is shorter than fourteen days, and
offering it neither waives the exemption above nor creates a statutory
cooling-off period for these bookings.
5.6 How Refunds Are
Paid — Money or LEAP Coins
A refund under this Section 5 is paid either to your original
payment method or as LEAP coins, bookaLEAP’s
in-app credit, at a value equal to the amount refunded. Which of the two
applies is set by the rules below, not by the reason you give. The app
tells you which you will receive, and the amount, before you confirm a
cancellation.
Your money is returned to your original payment method
when:
- we, an Organizer, a Partner or a Business cancel —
any cancellation under Section 5.1, 5.3, or the refundable limb of
Section 5.4. No time limit applies to these;
- you cancel shortly after paying — there is a
cash-refund window immediately following payment, during which
cancelling your own booking returns your money rather than credit. The
window is currently one hour from the moment your
payment completes. It never runs past the booking’s own cancellation
cutoff or deadline (Sections 5.1 and 5.2), so a booking made close to
that deadline has a correspondingly shorter window. The app always shows
the exact time by which you must cancel to be refunded in money — rely
on that time rather than on the one-hour figure;
- the booking could not be fulfilled — for example a slot collision or
a sold-out price tier (Section 4); or
- mandatory Dutch or EU consumer protection law requires a monetary
refund.
You are refunded in LEAP coins when you cancel your
own booking after the cash-refund window has closed but before the
cancellation cutoff or deadline. LEAP coins can be used like money on
the platform — to book any event, session, or offer — but have no cash
value and cannot be redeemed for cash or transferred.
The two methods are never combined for the same booking: a refund is
paid wholly in money or wholly in coins. Where a purchase earned you a
LEAP coins bonus, that bonus is deducted from your balance when the
purchase is refunded. On a refund paid in money there is no offsetting
credit, so if you have already spent the bonus your coin balance may go
below zero; it cannot be spent while negative and is cleared by coins
you earn afterwards.
Money refunds are returned through Stripe to the payment method you
used and normally appear within a few working days.
Sessions booked with a punch-card or combo-pack credit are settled in
pack credit under Section 5.1 and are outside this Section: no money or
LEAP coins refund arises for them.
5.7 Asking Us to Review a
Refund
If Sections 5.1 to 5.6 give you no refund but you believe your
circumstances justify one — you are taken ill on the morning of a class,
for example — you can ask us to look at it. The request is made from the
booking in the app, is available for any booking you paid for, and can
be submitted up until the session or event starts. Tell us the
reason.
We read every request and reply with a decision either way. If we
decline, we tell you why. If we approve, we decide whether to refund in
money or in LEAP coins and tell you which you have received.
This is a discretionary review, not an additional entitlement. It
neither limits nor replaces Section 5.3, Section 5.4, or your rights
under mandatory Dutch or EU consumer protection law — where any of those
give you a refund, you receive it whether or not you use this route.
5.8 Force Majeure
Neither bookaLEAP nor an Organizer is liable for the cancellation,
postponement, or alteration of an event due to circumstances beyond its
reasonable control, including extreme weather, government restriction,
public health measures, or unavailability of a venue for reasons outside
its control. In such cases, an alternative date or credit will be
offered where reasonably possible; a cash refund is not guaranteed
unless required by law.
6. Liability Disclaimer
& Assumption of Risk
6.1 Inherent Risk of
Physical Activity
Physical activity and wellness services carry inherent risks,
including but not limited to muscle strain, sprains, fractures,
cardiovascular incidents, and, in rare cases, serious or fatal injury.
By booking or attending any session or event through bookaLEAP — whether
delivered by an independent Partner, a Business, or organized directly
by bookaLEAP — you voluntarily and knowingly assume these inherent risks
and participate at your own risk.
6.2 Events Organized
Directly by bookaLEAP
For events where bookaLEAP is the organizer:
- bookaLEAP takes reasonable care in selecting qualified coaches and
instructors and in choosing appropriate venues for the activity
offered.
- You are responsible for providing accurate and complete health
information before participating (see Section 6.4), and for informing
the coach or event staff on-site of any condition that could affect your
safety.
- You must follow all safety instructions given by coaches,
instructors, and event staff at all times.
- bookaLEAP is only liable for injury, loss, or damage at a
bookaLEAP-organized event if it was caused by bookaLEAP’s own gross
negligence or intentional misconduct (including that of its direct
employees or contractors). Where the law does not allow liability to be
limited — such as for death or personal injury caused intentionally or
by gross negligence — that liability remains.
- bookaLEAP is not liable for injury, loss, or damage caused by: (a)
your failure to disclose relevant health information; (b) your failure
to follow safety instructions; (c) a pre-existing medical condition you
did not disclose; or (d) risks inherent to the activity that were
reasonably communicated to you in advance.
6.3
Partner- and Business-Delivered Services and Events
bookaLEAP does not guarantee the outcome or quality of services or
events offered by independent Partners, Businesses, or third-party
Organizers. The contract for these services is between you and that
provider. bookaLEAP is not liable for a provider’s acts or omissions,
except to the extent bookaLEAP has failed to meet its verification
obligations under Section 10.
You confirm that any health, injury, fitness, or medical information
you provide — whether in event registration answers, to a Partner, or at
an event — is accurate and complete to the best of your knowledge.
Failure to disclose relevant health conditions may endanger your safety
and may limit bookaLEAP’s and the provider’s liability for any resulting
harm. If you have a pre-existing medical condition, we recommend
consulting a physician before beginning a new activity or programme.
7. User Content
- You may publish content on the platform (for example feed posts,
images, and reviews). You retain ownership of your content and grant
bookaLEAP a non-exclusive, worldwide, royalty-free license to host,
display, and distribute it as needed to operate and promote the
platform.
- You must have the rights to any content you upload, and it must
comply with the Code of Conduct. Do not upload content that is unlawful,
infringing, misleading, or harmful.
- bookaLEAP may remove or hide content that violates these Terms or
the Code of Conduct. To report content, contact info@bookaleap.com; we
review reports and act on justified notices, and we inform affected
users of removals where required by law.
8. Reviews and Ratings
Reviews are user content, and Section 7 applies to them in full. The
rules specific to reviews:
- Only attendees may review. You can review a Partner
who coached you, or a Business whose venue hosted you, only after a
booking you personally made and attended. We resolve who you may review
from that booking, not from what you tell us — you cannot review
yourself, a Partner or Business you did not train with, or a booking
that was cancelled or has not happened yet.
- One review per booking per subject. A booking with
several coaches and a venue lets you review each of them once. Every
rating is optional; submitting some and not others is fine.
- A time limit. You may submit a review, and change
one you have written, for 14 days after the booking finishes. After that
the review stands as written. You may delete your own review at any
time, with or without the window open.
- Reviews publish immediately. We do not check a
review before it appears. A review is a whole number of stars from 1 to
5 and, if you choose, up to 1,000 characters of text. It is shown
publicly next to the Partner’s or Business’s profile together with your
first name and profile picture — not your full name, phone number, or
email.
- Ratings shown on a profile are the average of the
visible reviews for that account. Hiding a review removes it from the
average.
- Your review must be your own honest experience of
the booking it is attached to. Do not post reviews that are paid for,
traded, written on someone else’s behalf, or about anything other than
the service you received. Do not include other people’s personal
data.
- Reporting a review. Any signed-in user can report a
published review. We assess reports and, where a review breaches these
Terms, the Code of Conduct, or the law, we hide it. When we hide a
review we tell its author what we decided and why, and the author can
contest that decision by replying to that notice or writing to
info@bookaleap.com. Reporting a review does not hide it while we assess
it.
- If you delete your account, your reviews are
anonymised rather than removed: the rating and text stay so that a
Partner’s or Business’s rating history is not rewritten by unrelated
account closures, but nothing identifying you remains attached to them.
This is explained further in the Privacy Policy.
9. User Conduct
You agree not to:
- Provide false information.
- Use the platform for illegal purposes.
- Harass, abuse, or harm other users or professionals.
- Circumvent the platform to avoid fees.
The Code of Conduct forms part of these Terms. bookaLEAP may suspend
or terminate your access for violations of these rules; the “Violations”
section of the Code of Conduct describes the review process.
10. Partner Verification
Professionals and Businesses are verified before being listed on the
platform, and must complete identity and financial verification before
receiving payouts. However, bookaLEAP does not guarantee the accuracy of
qualifications or fitness for your personal needs.
11. Partners
and Businesses — Fees, Payouts, and Reporting
- Platform commission rates and the applicable legal model (merchant
of record or disclosed agent) are shown to Partners and Businesses per
listing category and frozen at the time of each transaction.
- Payouts are made by SEPA bank transfer in periodic payout batches to
the verified bank account on file, no later than one month after the
session or event date. bookaLEAP issues self-billing invoices for
payouts with the Partner’s or Business’s consent, given at
onboarding.
- bookaLEAP may be legally required to report Partner and Business
identification and revenue data to the Dutch tax authority (including
under DAC7).
- Partners and Businesses must not make false or misleading public
statements about bookaLEAP or its users. Honest reviews and opinions are
not restricted.
- Accepting or soliciting off-platform payment for a booking initiated
through the platform — including listing a reduced price in-app and
collecting the difference directly — is a material breach of these Terms
and may result in suspension or termination of the account and recovery
of the evaded fees.
12. Dispute Resolution
Disputes between Clients and Partners, Businesses, or third-party
Organizers must be resolved directly between the involved parties.
bookaLEAP is not responsible for mediating or resolving such disputes.
Disputes relating to a booking, fee, or event organized directly by
bookaLEAP should first be raised with bookaLEAP at info@bookaleap.com.
Consumers in the EU may also use the European Commission’s Online
Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
13. Intellectual Property
All content on the platform other than user content — including
branding, code, and designs — is the property of bookaLEAP and may not
be copied or reused without permission. User content is governed by
Section 7.
14. Governing Law and
Jurisdiction
These Terms are governed by the laws of the Netherlands. Any disputes
will be subject to the exclusive jurisdiction of the courts of
Amsterdam.
15. Changes to Terms
We may update these Terms at any time. Material changes will be
communicated via app notification or email. Continued use of the
platform constitutes acceptance of the updated Terms.
